HBA-TYH H.B. 891 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 891 By: Hamric County Affairs 2/19/1999 Introduced BACKGROUND AND PURPOSE Current statutes require emergency services districts and rural fire prevention districts located wholly in one county to file with the commissioners court of the county an annual report of the district's administration for the preceding calendar year and financial condition, and an annual audit report. These two reports substantially duplicate each other. H.B. 891 provides that an emergency services district or rural fire prevention district located wholly in one county is not required to file the report of the district's administrative and financial condition with the court. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 775.036(d), Health and Safety Code, to provide that Subsection (a)(4) does not apply to the board of emergency services commissioners (board) of an emergency services district created under this chapter and located wholly in one county. Deletes the requirement for the board to include certain enumerated information in the report under Subsection (a)(4). SECTION 2. Amends Section 794.035(d), Health and Safety Code, to provide that Subsection (a)(4) does not apply to the board of fire commissioners (board) of a rural fire prevention district created under this chapter and located wholly in one county. Deletes the requirement for the board to include certain enumerated information in the report under Subsection (a)(4). SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
