HBA-JRA H.B. 840 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 840 By: Garcia Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently, a student may attend a public school in the district in which the student resides or use a public education grant to attend any other district chosen by the student's parent. H.B. 840 provides that an eligible student is entitled to such a transfer if the student's enrollment would not cause the district to exceed the class size limit of 22 students in a kindergarten, first, second, third, or fourth grade class. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 29.201, Education Code, to provide the qualification that an eligible student is entitled to attend a public school in the district in which the student resides or use a public education grant to attend any other district chosen by the student's parents if the student's enrollment would not cause the district to exceed the class size limit of 22 students in a kindergarten, first, second, third, or fourth grade class, with exceptions, as of the date of the student's enrollment. Makes conforming changes. SECTION 2. Amends Section 29.203(d), Education Code, to make nonsubstantive changes. SECTION 3. Makes application of this Act prospective to the 1999-2000 school year. SECTION 4. Emergency clause. Effective date: upon passage.
