BACKGROUND AND PURPOSE 

In 1935, a bracket bill was adopted that required all county employees in a
county with a population of 500,000 or more to be employed by a written
contract.  Since adoption of this legislation, many counties have grown
into that population bracket and some of those counties have their
employees covered by the civil service system under Chapter 158 (County
Civil Service).  H.B. 809 excludes counties that are covered by the civil
service system from the provision that county employees in a county with a
population of 500,000 or more must be employed by a written contract.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 151.902, Local Government Code, by adding
Subsection (d), to establish that this section (Employment Contracts in
County With Population of 500,000 or More) does not apply to the employment
of a person who is employed under a county civil service system created
under Chapter 158 (County Civil Service). 

SECTION 2.  Emergency clause.
  Effective date: upon passage.
