HBA-JRA H.B. 711 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 711 By: Krusee Public Education 4/17/1999 Introduced BACKGROUND AND PURPOSE Currently, the State Board of Education is authorized to grant no more than 100 charters for openenrollment charter schools. The board is authorized to grant additional charters for students who are considered "at risk." H.B. 711 authorizes the board to provide additional charter schools for students who reside in a school district that ranks in the lowest third for student performance on assessment instruments adopted by the Texas Education Agency. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 12.1011(a), Education Code, to authorize the State Board of Education to grant additional charters, in accordance with this subchapter, for open-enrollment charter schools that will serve only students who reside in school districts that rank in the lowest third for student performance on assessment instruments administered under Section 39.023 (Adoption and Administration of Instruments) for the school year preceding the year the charter is granted. Makes conforming changes. SECTION 2. Emergency clause. Effective date: upon passage.
