HBA-NMO H.B. 663 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 663 By: Hilderbran Criminal Jurisprudence 2/26/1999 Introduced BACKGROUND AND PURPOSE Current law does not classify the murder of a individual under an order of protection as a capital murder. Orders of protection are often an attempt to prevent recurring domestic violence. Domestic violence can result in murder. H.B. 663 classifies the murder of an individual under an order of protection, when the order was directed to the person who committed the murder, as a capital murder. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 19.03(a), Penal Code, to include the murder of a person protected by specified orders of protection, when the order was directed to the actor, in the list of aggravating factors which make a murder a capital murder. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
