BACKGROUND AND PURPOSE

Current law does not classify the murder of a individual under an order of
protection as a capital murder. Orders of protection are often an attempt
to prevent recurring domestic violence. Domestic violence can result in
murder. H.B. 663 classifies the murder of an individual under an order of
protection, when the order was directed to the person who committed the
murder, as a capital murder.

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.
