BACKGROUND AND PURPOSE 

Currently, historically underutilized businesses are allowed to exempt
certain information from public information laws.  Businesses that are
potential vendors or contractors for public entities are required to
disclose this information.  H.B. 413 repeals the exemption of historically
underutilized businesses from reporting certain information. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Repealer:  Section 552.127, Exception: Certain Information
submitted by Potential Vendors and Contractors, Government Code, as added
by Chapter 1227, Acts of the 75th Legislature, Regular Session, 1997.
Section 552.127 provides an exception to a disclosure requirement for
certain information provided by potential vendors or contractors with an
application for certification as a historically underutilized or
disadvantaged business. 

SECTION 2.  Emergency clause.
            Effective date:  90 days after adjournment.
