BACKGROUND AND PURPOSE 

C.S.H.B. 3846 requires that the Sabine River Authority Board of Directors
be composed of four members from the upper and four members from the lower
basin.  Currently, there is no requirement regarding representation of the
basins. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 3, Article 8280-133, V.T.C.S. (Chapter 110, Acts
of the 51st Legislature, Regular Session, 1949), to modify residency
requirements for the board of directors of the Sabine River Authority of
Texas. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Defines "upper basin of the Sabine River" and "lower basin of
the Sabine River." Requires the governor to appoint members of the board of
the directors when positions become vacant in a specified manner. 

SECTION 4.  Emergency clause.
  Effective date: upon passage.

COMPARISON OF ORIGINAL TO SUBSTITUTE

The substitute differs from the original by deleting SECTION 2 of the
original relating to making the Sabine River Authority of Texas subject to
review under Chapter 325, Government Code (Texas Sunset Act), as if it were
a state agency subject to review under that chapter. 

The substitute differs from the original by redesignating SECTIONS 3-5 of
the original as SECTIONS 2-4 of the substitute.
