BACKGROUND AND PURPOSE 

H.B. 3846 requires that the Sabine River Authority Board of Directors be
composed of four members from the upper and four members from the lower
basin.  Currently, there is no requirement regarding representation of the
basins. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 3, Article 8280-133, V.T.C.S. (Chapter 110, Acts
of the 51st Legislature, Regular Session, 1949), to modify residency
requirements for the board of directors of the Sabine River Authority of
Texas. 

SECTION 2.  Amends Article 8280-133, V.T.C.S. (Chapter 110, Acts of the
51st Legislature, Regular Session, 1949), by adding Section 1A, as follows: 

Sec.  1A.  Provides that the Sabine River Authority of Texas is subject to
review under Chapter 325, Government Code (Texas Sunset Act), as if it were
a state agency subject to review under that chapter, and unless continued
in existence as provided by that chapter, the district is abolished and
this Act expires September 1, 2001. 

SECTION 3.  Makes application of this Act prospective.

SECTION 4.  Defines "upper basin of the Sabine River" and "lower basin of
the Sabine River." Requires the governor to appoint members of the board of
the directors when positions become vacant in a specified manner. 

SECTION 5.  Emergency clause.
  Effective date: upon passage.
