BACKGROUND AND PURPOSE 

The county court at law of Randall County is the only court in operation
every working day at the Randall County Courthouse, and the court has
determined that a need exists for greater security. H.B. 3803 amends
Chapter 53, Government Code (Bailiffs), to authorize the Randall County
court at law to appoint a bailiff, and to require the commissioners court
to establish a salary for the appointed bailiff.  Under Section 53.0071
(Bailiff as Peace Officer), a bailiff appointed under Section 53.001(g)
must be a peace officer as defined under Art. 2.12, Code of Criminal
Procedure (Who are peace officers.). 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 53.001(g), Government Code, to require the judge
of the county court at law in Randall County to appoint a bailiff.  Makes
conforming changes. 

SECTION 2.  Amends Section 53.009(a), Government Code, to entitle a bailiff
appointed by a judge of a county court at law in Randall County to a salary
set by the judge and approved by the commissioners court.  Makes conforming
changes. 

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
