BACKGROUND AND PURPOSE 

C.S.H.B. 3741 specifies that the Department of Protective and Regulatory
Services must conduct a comprehensive cost-benefit analysis and economic
impact study for minimum standards revisions concerning non-residential
childcare facilities that impact staff-child ratios, group sizes, or square
footage.  This bill requires a child-placing agency to transfer its files
and records to the Bureau of Vital Statistics when the agency terminates
operations. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 42.042(m), Human Resources Code, to specify that
the minimum standards for nonresidential child-care facilities are for
minimum standards relating to staff-to-child ratios, group sizes, or square
footage requirements. 

SECTION 2.  Amends Section 42.045(c), Human Resources Code, to require a
child-placing agency that terminates operation to transfer its files and
records concerning adopted children, their biological families, and their
adoptive families to the Bureau of Vital Statistics, rather than the Texas
Department of Human Services.  Makes a conforming change. 

SECTION 3.  Amends Section 42.078(e), Human Resources Code, to specify that
director refers to the executive director in this subsection. 

SECTION 4.  Effective date: September 1, 1999.

SECTION 5.  Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 3741 modifies the original to conform to Legislative Council
format.
