Introduced

BACKGROUND AND PURPOSE

Current law requires the board of trustees of a school district to report
an order placing a student in an alternative education program to a
juvenile court if the violation occurs under Section 37.006, Education
Code. Some districts also report students to juvenile courts who have been
placed in alternative education programs due to conduct that is not
criminal. H.B. 3732 exempts a student placed in an alternative program
under Section 37.002(c) (Removal by Teacher), Education Code, from being
reported to a juvenile court.

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.
