HBA-SEB H.B. 3586 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3586 By: Flores Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently, certain nepotism prohibitions apply to public officials. H.B. 3586 provides that those nepotism prohibitions do not apply to an appointment or employment of a person by a school district if the person was previously employed by the district for at least five years before the election or appointment of the public official to whom the person is related in a prohibited degree. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 573.061, Government Code, to provide that Section 573.041 (Prohibition Applicable to Public Official) does not apply to an appointment or employment of a person by a school district if the person was previously employed by the district for at least five years before the election or appointment of the public official to whom the person is related in a prohibited degree. SECTION 2. Makes application of this Act prospective. SECTION 3.Emergency clause. Effective date: upon passage.
