HBA-EVB H.B. 3314 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3314 By: Cuellar Land & Resource Management 4/7/1999 Introduced BACKGROUND AND PURPOSE Municipalities and economic development corporations have occasionally expressed an interest in donating real property to components of the University of Texas System. However, political subdivisions of the state (subdivisions) are currently unable to donate, exchange, convey, sell, or lease land or an interest in real property to an institution of higher education for less than its fair market value without complying with the notice and bidding requirements of Subsection (a), Section 272.001 (Notice of Sale or Exchange of Land by Political Subdivision; Exceptions), Local Government Code. H.B. 3314 authorizes a political subdivision to do so. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 272.001, Local Government Code, to authorize a political subdivision to donate, exchange, convey, sell, or lease land or an interest in real property to an institution of higher education, as that term is defined by Section 61.003 (Definitions), Education Code, to promote a public purpose related to higher education. Requires the political subdivision to determine the terms and conditions of the transaction so as to effectuate and maintain the public purpose. Authorizes a political subdivision to donate, exchange, convey, sell, or lease the land or interest for less than its fair market value and without complying with the notice and bidding requirements of Subsection (a). Makes conforming changes. SECTION 2. Emergency clause. Effective date: upon passage.
