BACKGROUND AND PURPOSE 

Under current law, a wholesaler is only authorized to transport alcoholic
beverages in vehicles that are owned or leased by that wholesaler. This
bill allows employees of a wholesaler to transport small quantities of
alcoholic beverages in the normal course of making routine sales calls in
order to increase cost-efficiency. 

H.B. 3183 allows a person holding an agent's permit (employee) to transport
alcoholic beverages in a vehicle owned or leased by the employee if the
wholesaler adds the employee's vehicle to the list of vehicles operating
under the private carriers permit. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 42.01(a), Alcoholic Beverage Code, to authorizes
the holder of a private carrier permit who holds a brewer's, distiller's
and rectifier's, winery, wholesaler's, class B wholesaler's, or wine
bottler's permit to transport liquor for specified lawful purposes in a
vehicle owned or leased by the holder issued under Chapter 35 (Agent's
Permit), in addition to a vehicle owned or leased in good faith by the
holder of a private carrier permit. 

SECTION 2.Effective date: September 1, 1999.

SECTION 3.Emergency clause.
