BACKGROUND AND PURPOSE 

Under current law, the commissioners court of Lubbock County has the
authority to appoint the Board of Managers of the Lubbock County Hospital
District.  The purpose of this bill is to allow the Texas Tech University
board of regents (regents) to appoint one member to serve on board of
managers. As proposed, H.B. 2961 requires the regents to appoint one member
to the  board of hospital managers and the commissioners court to appoint
the remaining members  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 8, Chapter 484, Acts of the 60th Legislature,
Regular Session, 1967, to require the Texas Tech University board of
regents (regents), along with the commissioners court of Lubbock County, to
appoint a board of hospital managers in the manner provided.  Requires the
regents to appoint one member and the commissioners court to appoint the
remaining members. 

SECTION 2.  (a) Effective date: September 1,1999.

(b) Provides that the change in law made by this Act relating to the
composition of the board of hospital managers of the Lubbock County
Hospital District does not affect the eligibility of a member serving
immediately before the effective date of this Act to continue to serve on
the board for the term to which the member was appointed. Requires the
regents to appoint a member to the board of hospital managers in accordance
with Section 8, Chapter 484, Acts of the 60th Legislature, Regular Session,
1967, as amended by this Act, to fill the next vacancy that occurs after
the effective date of this Act. 

SECTION 3.  Emergency clause.                   

EXPLANATION OF AMENDMENTS

Amendment # 1

Amends H.B. 2961, in SECTION 1 (Section 8, Chapter 484, Acts of the 60th
Legislature, Regular Session, 1967), to require the Texas Tech University
board of regents to appoint one ex-officio member and the commissioners
court to appoint the remaining members.  Requires the appointed ex-officio
member to have all powers of a member of the board, except that the member
may not vote.  Requires the appointed ex-officio member to have access to
all documents reviewed or considered by the board or its staff, and to have
any and all other powers of a member of the board with the exception of
voting.
