BACKGROUND AND PURPOSE

Prior to the 76th Legislature, Section 573.041, Government Code, prohibited
a public official from hiring or appointing an individual who will be
compensated directly or indirectly with public funds if the individual is
related to the public official within the third degree by consanguinity or
the second degree by affinity. Public officials in small incorporated
municipalities, with populations of 200 or less, had difficulty hiring
employees that are not related within those degrees of relationship. H.B.
2930 provides an exception for a municipality that has a population of 200
or less.

officer, department, agency, or institution.
