HBA-LCA H.B. 2830 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2830 By: Isett Juvenile Justice & Family Issues 3/28/1999 Introduced BACKGROUND AND PURPOSE In certain divorce situations, a person seeking the divorce is already in a relationship with another person. H.B 2830 allows a court to bring a temporary injunction, at the request of a party to a divorce suit, against such a third party. The injunction would prohibit the third party, during the pendency of the suit, from communicating with the movant's spouse or engaging in conduct that would impede a reconciliation between the parties to the divorce suit. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter F, Chapter 6, Family Code, by adding Section 6.508, as follows: Sec. 6.508. TEMPORARY INJUNCTION AGAINST THIRD PARTY. Authorizes a court to render a temporary injunction against a person who is not a party to a suit for dissolution of a marriage. Provides that the temporary injunction, during pendency of the suit, prohibits the third party from certain, specified actions. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
