HBA-ALS H.B. 2782 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2782 By: Oliveira Land & Resource Management 4/6/1999 Introduced BACKGROUND AND PURPOSE As the university systems in Texas have expanded, their interaction with public junior colleges and junior college districts has increased. As a result of new partnerships between these entities, resources are being shared by junior colleges and junior college districts and the university systems in order to enhance student services and access to higher education. The purpose of this bill is to grant junior colleges and junior college districts statutory authority to transfer real property to university systems. H.B. 2782 allows a public junior college or a public junior college district to donate, sell or lease any interest in real property to a university system if it promotes a public purpose related to higher education in the service area of the public junior college or the public junior college district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter A, Chapter 130, Education Code, by adding Sec. 130.0021, as follows: Sec. 130.0021. CONVEYANCE OF CERTAIN REAL PROPERTY. Authorizes a public junior college or a public junior college district to donate, exchange, convey, sell or lease land, improvements, or any other interest in real property for less than the fair market value if it is made to a university system and the governing board of the public junior college or the public junior college district finds that it promotes a public purpose related to higher education in the service area of the public junior college or the public junior college district. SECTION 2. Emergency clause. Effective date: upon passage.
