HBA-SEB H.B. 277 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 277 By: Flores Public Education 2/8/1999 Introduced BACKGROUND AND PURPOSE Currently, only classroom teachers and full-time librarians are entitled to a 30-minute duty-free lunch. H.B. 277 entitles all school employees to a 30-minute lunch, free from all school duties. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Transfers Section 21.405, Education Code, to Subchapter A, Chapter 22, Education Code, and redesignates the section to Section 22.006, and amends newly designated Section 22.006, Education Code, as follows: Sec. 22.006. DUTY-FREE LUNCH. Entitles each school district employee who works in a school in the district, rather than only a classroom teacher or full-time librarian, to at least a 30-minute lunch free from all school duties, except during a personnel shortage, an extreme economic condition, or an unavoidable or unforeseen circumstance. Makes conforming and nonsubstantive changes. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
