HBA-NLM C.S.H.B. 2662 76(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 2662 By: Ramsay County Affairs 4/9/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Under current law, purchasing agents appointed by the commissioners court under Section 262.0115 (Purchasing Agents in Counties With Population of More Than100,000), Local Government Code, do not have the same purchasing authority and purchasing functions as those appointed by a board under Section 262.011 (Purchasing Agents). C.S.H.B. 2662 to include the functions prescribed for a purchasing agent under Section 262.011 (Purchasing Agents), Local Government Code, among the functions of a purchasing agent appointed under Section 262.0115. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 262.0115(d), Local Government Code, to include the functions prescribed for a purchasing agent under Section 262.011 (Purchasing Agents), Local Government Code, among the functions of the purchasing agent. SECTION 2. Emergency clause. Effective date: upon passage. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 2662 modifies the original in SECTION 1 (Section 262.0115(d), Local Government Code) by removing from the functions to be carried out by a purchasing agent, a function prescribed by an order of the commissioners court.
