BACKGROUND AND PURPOSE 

Currently, the Texas Department of Health (TDH) is authorized to establish
a registry for persons who are required to comply with certain portions of
the Medical Radiologic Technologist Certification Act.  According to an
attorney general opinion, under current law TDH may not collect a fee to
add people to this registry.  Therefore, TDH's additional workload is
unfunded.  H.B. 2636 authorizes TDH to set fees to cover the costs of
registering non-certified technicians and granting hardship exemptions. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 2.09, Article 4512m, V.T.C.S. (Medical
Radiologic Technologist Certification Act), as follows:  

(d)  Authorizes the Texas Board of Health (board) to set fees to register a
person required to comply with Section 2.05(f) of this Act, regarding
mandatory training guidelines, or to process an application under Section
2.05(i) of this Act for a hardship exemption from the registration
requirement.  Makes conforming changes. 

(e)  Requires the board to set fees under Subsection (d), rather than the
fees, in amounts that are reasonable to cover the costs of administering
this Act without the use of additional general revenue funds. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
