HBA-SEB H.B. 2584 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2584 By: Eiland Pensions and Investments 3/22/1999 Introduced BACKGROUND AND PURPOSE Currently, a peace officer who has performed prior state law enforcement service does not receive credit for that service if the officer enters a county or municipal law enforcement agency that participates in the Texas County and District Retirement System (TCDRS). H.B. 2584 allows a member of TCDRS to establish credit in TCDRS for previous service as a peace officer who made contributions to the Employees Retirement System of Texas. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter E, Chapter 843, Government Code, by adding Section 843.405, as follows: Sec. 843.405. PREVIOUS PEACE OFFICER SERVICE. Authorizes a contributing member of the Texas County and District Retirement System (TCDRS) to establish credit for current service in TCDRS for service previously performed as a peace officer licensed by the Commission on Law Enforcement Officer Standards and Education and commissioned by a state agency included in the coverage of the Employees Retirement System of Texas (ERS). Requires a member claiming that credit to file a detailed statement of service with TCDRS and to make a deposit of a specific amount with TCDRS. Requires TCDRS to grant the current service credit after verifying the service and receipt of the deposit. Prohibits credit from being established for service while it is credited in ERS. SECTION 2. Amends Section 845.306(a), Government Code, to make conforming changes. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
