HBA-JRA, NMO H.B. 2382 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2382 By: Coleman Public Health 7/22/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, the law required the Texas Board of Physical Therapy Examiners (board) to develop, by rule, a process to evaluate and approve continuing education courses. The outsourcing of this process may enhance the quality of the continuing education courses and may also reduce the demands on board support staff. H.B. 2382 requires the board to authorize licensee peer organizations to evaluate and approve continuing education courses in accordance with the established process. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority previously delegated to the Texas Board of Physical Therapy Examiners is modified in SECTION 1 (Section 16A, Chapter 836, Acts of the 62nd Legislature, Regular Session, 1971 (Article 4512e, V.T.C.S.)) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 16A, Chapter 836, Acts of the 62nd Legislature, Regular Session, 1971 (Article 4512e, V.T.C.S.), by requiring the Texas Board of Physical Therapy Examiners (board) to authorize licensee peer organizations to evaluate and approve continuing education courses in accordance with the established process, which the board is required to develop, by rule. SECTION 2.Emergency clause. Effective date: upon passage.
