HBA-LCA H.B. 2367 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2367 By: Wilson Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently, if a student receives a grade lower than a 70 on a scale of 100, that student is suspended from extracurricular activity sponsored or sanctioned by the school. H.B. 2367 amends the law to allow a student to participate in these activities unless the student's grade average is lower than 70. This bill prevents a student from being suspended from extracurricular activities because of what could be an isolated grade. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 33.081(c) and (d), Education Code, as follows: (c) Requires a school district to suspend a student from any extracurricular activity sponsored or sanctioned by the school district or the University Interscholastic League after a grade evaluation period in which the student's grade average, rather than any grade, for academic classes excluding honors or advanced classes is lower than 70 percent. (d) Provides for the removal of the suspension under Subsection (c) once the student's grade average, rather than grade, is equal to or greater than 70 percent in classes excluding identified honors or advanced classes. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
