HBA-GUM, KMH H.B. 2313 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2313 By: McReynolds Judicial Affairs 7/7/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Texas Legislature, the judges of the district courts having jurisdiction in Angelina County were not required to appoint a bailiff. The bailiffs in Angelina County are funded through the district court and are under the authority of the sheriff. The authority granted to the sheriff's office requires that the office maintain all records relating to the bailiff's commission through the Texas Commission on Law Enforcement Officer Standards and Education. H.B. 2313 requires judges of the district courts having jurisdiction in Angelina County to appoint a bailiff. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 53.001(a), Government Code, to require the judges of the district courts having jurisdiction in Angelina County to appoint a bailiff. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
