BACKGROUND AND PURPOSE

Prior to the 76th Legislature, the installation, repair, or removal of
certain types of vent hoods was covered under the Air Conditioning and
Refrigeration Contractor License Law (Article 8861, V.T.C.S.). As then
written, the installation, repair, or removal of a vent hood in any
location other than one's home had to be completed by a licensed air
conditioning and refrigeration contractor. Requiring such a simple
procedure to be performed by a licensed air conditioning and refrigeration
specialist was unnecessary and costly to consumers. H.B. 1997 removes the
simple procedure of installation, repair, or removal of vent hoods from the
purview of the Air Conditioning and Refrigeration Contractor License Law.

not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.
