HBA-GUM H.B. 1881 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1881 By: Brimer Judicial Affairs 4/13/1999 Introduced BACKGROUND AND PURPOSE In 1995, the 74th Texas Legislature authorized the city of Kennedale to create a municipal court of record. When it was created, Kennedale was a general law city unable to enforce municipal ordinances outside of its city limits. H.B. 1881 provides that a municipal court of record has the jurisdiction provided by general law for municipal courts. This bill also provides that the court has jurisdiction over cases arising outside the territorial limits of the municipality. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter E, Chapter 30, Government Code, by adding Section 30.001835, as follows: Sec. 30.001835. JURISDICTION. Provides that a municipal court of record has the jurisdiction provided by general law for municipal courts. Provides that the court has jurisdiction over cases arising outside the territorial limits of the municipality under any ordinance authorized by state law to be enforced outside the territorial limits of the municipality. SECTION 2. Emergency clause. Effective date: upon passage.
