HBA-MAJ H.B. 184 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 184 By: Longoria Public Education 2/9/1999 Introduced BACKGROUND AND PURPOSE Currently, a school district is not required to keep school buildings open after school or on the weekends. H.B. 184 requires the board of trustees of a school district to adopt rules to keep school buildings in the district open to the public for recreational activities, tutoring, and library services during those times by requiring school facilities to be open a minimum of two hours each evening and five hours a day on the weekends, with supervision to be provided by volunteers. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter D, Chapter 11, Education Code, by adding Section 11.165, as follows: Sec. 11.165. ACCESS TO SCHOOL BUILDINGS. Requires the board of trustees of an independent school district to adopt rules that keep school buildings in the district open after school hours for student recreational activities and tutoring. Provides that a school building and school library must be open for a minium of two hours each evening and five hours a day on weekends. Requires the school district to provide supervision of the activities and use of the school building through volunteers approved by the district. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
