HBA-RBT H.B. 1548 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1548 By: Danburg Elections 4/12/1999 Introduced BACKGROUND AND PURPOSE H.B. 1548 modifies the deadline that the holder of an office must file an application for a place on the ballot for that office. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 142.006, Election Code, by amending Subsection (a) and adding Subsection (c) to provide that an application for a place on the ballot by a person who holds the office must be filed before 5 p.m. of the 27th day after runoff primary election day. SECTION 2. Amends Section 143.007, Election Code, by adding Subsection (c), to provide that an application for a place on the ballot by a person who holds the office must be filed before 5 p.m. of the 42nd day before election day. SECTION 3. Amends Section 144.005, Election Code, by adding Subsection (c) to make a conforming change. SECTION 4. Amends Section 172.023, Election Code, by amending Subsection (a) and adding Subsection (c), to provide that an application for a place on the general primary election ballot by a person who holds the office for which the application is made must be filed no later than 6 p.m. on December 30 in the year preceding the primary election year. SECTION 5. Amends Section 181.033, Election Code, to make conforming changes. SECTION 6. Amends Section 11.055, Education Code, to make conforming changes. SECTION 7. Effective date: September 1, 1999. SECTION 8. Emergency clause.
