HBA-MPM H.B. 1326 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1326 By: Solis, Jim Public Education 3/21/1999 Introduced BACKGROUND AND PURPOSE School districts in Texas report drop-out information annually to the Texas Education Agency regarding students in grades seven through 12. Districts do not always communicate with each other when a student transfers from one district to another, which may not accurately reflect the drop-out rate statistics. H.B. 1326 requires school districts to report the enrollment of a student to the school district in which the student was previously enrolled within 30 days. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter B, Chapter 25, Education Code, by adding Section 25.043, as follows: Sec. 25.043. NOTIFICATION. Requires the school district in which a student enrolls to notify the district from which the student transferred no later than the 30th day after the student transfers from one intrastate district to another. Specifies that a district is not required to provide notice of transfer if the student's transfer is pursuant to an agreement between the districts. SECTION 2. Amends Section 29.204, Education Code, by adding Subsection (c), as follows: (c) Requires the district in which a student enrolls to notify the district from which the student transferred no later than the 30th day after the student transfers from one district and enrolls in another using a public education grant. SECTION 3. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 4. Emergency clause.
