BACKGROUND AND PURPOSE 

Currently, a county attorney, district attorney, or criminal district
attorney is authorized to collect a $10 fee if the attorney's office
collects and processes a dishonored or forged check or sight order which
has a face amount of under $100.  H.B. 1277 allows the collection of a $10
fee if the check or sight order is under $10, and a $15 fee if it is
between $10 and $100. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article 102.007(c), Code of Criminal Procedure, to
authorize a county attorney, district attorney, or criminal district
attorney to collect a $10 fee if the attorney's office collects and
processes a dishonored or forged check or sight order which has a face
amount of under $10, rather than under $100, and a $15 fee if it is between
$10 and $100.  Redesignates existing Subdivisions (2)-(4) to (3)-(5). 

SECTION 2.   Effective date: September 1, 1999.
  Makes application of this Act prospective.

SECTION 3.  Emergency clause.
