HBA-NLM H.B. 1228 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1228 By: Jones, Jesse Public Education 4/20/1999 Introduced BACKGROUND AND PURPOSE Currently, prekindergarten programs do not have specified provisions relating to the student/teacher ratio in classrooms. H.B. 1228 provides that a school district's prekindergarten program must maintain a student/teacher ratio equivalent to the staff/child ratio applicable to a child-care facility under Section 42.042 (Rules and Standards), Human Resources Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 29.153, Education Code, by adding Subsection (h), as follows: (h) Provides that a school district's prekindergarten program must maintain a student/teacher ratio equivalent to the staff/child ratio applicable to a child-care facility under rules adopted by the Department of Protective and Regulatory Services under Section 42.042 (Rules and Standards), Human Resources Code. SECTION 2. Provides that this Act applies beginning with the 1999-2000 school year. SECTION 3. Emergency clause. Effective date: upon passage.
