HBA-NLM H.B. 1226 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1226 By: Jones, Jesse Public Education 3/5/1999 Introduced BACKGROUND AND PURPOSE Currently, members of a school board are required to select a president, secretary, and all other officers and committees the board considers necessary at the first meeting after each election and qualification of trustees. H.B. 1226 requires a school board to elect officers of the board not more frequently than annually. This bill provides that if an office becomes vacant the board is authorized to select a trustee to fill the vacancy. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.061, Education Code, by amending Subsection (c) and by adding Subsection (e), as follows: (c) Includes an exception provided by Subsection (e). Requires the members to organize according to the provisions of this subsection not more frequently than annually, rather than at the first meeting after each election and qualification of trustees. (e) Authorizes the trustees to select a trustee at any time to serve as an officer if that office becomes vacant and to select any committees the trustees consider necessary. SECTION 2. Effective date: September 1, 1999. SECTION 3. Provides that Section 11.061(c), Education Code, as amended by this Act, does not prohibit a board of trustees from organizing and electing new officers on or after the effective date of the Act, regardless of the date on which the trustees previously selected officers. Provides that on the first date on or after the effective date of this Act that trustees select the officers, the trustees become subject to Section 11.061(c), Education Code, as amended by this Act, and are prohibited from selecting new officers for one year, except as provided by Section 11.061(e), Education Code, as amended by this Act. SECTION 4. Emergency clause.
