HBA-MPA H.B. 1116 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1116 By: Solis, Jim Ways & Means 4/15/1999 Introduced BACKGROUND AND PURPOSE H.B. 1116 allows municipalities with a population of 2,000 or less to use municipal hotel/motel tax revenue to provide law enforcement. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter B, Chapter 351, Tax Code, by adding Sections 351.1012 and 351.1066, as follows: Sec. 351.1012. USE OF REVENUE: SMALL MUNICIPALITIES. Authorizes a municipality with a population of less than 2,000 to use hotel occupancy tax revenue to provide police protection, in addition to the uses permitted by Section 351.101(a) which authorizes the tax to be used only to promote tourism and the convention and hotel industry. Sec. 351.1066. ALLOCATION OF REVENUE: SMALL MUNICIPALITIES. Authorizes a municipality with a population of less than 2,000 to allocate hotel occupancy tax revenue among the permitted uses as determined by ordinance. SECTION 2. Emergency clause. Effective date: upon passage.
