HBA-ATS H.B. 1072 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1072 By: Uher Judicial Affairs 3/16/1999 Introduced BACKGROUND AND PURPOSE Current state law requires an applicant seeking certification as a court reporter to type a transcript, using either a manual or electric typewriter, of the test material taken down by the applicant. Technological advancements have lessened the need for court reporting professionals to master the use of manual and electric typewriters to prepare transcripts of legal proceedings. H.B. 1072 provides that an applicant seeking certification as a court reporter must now prepare, rather than type, a transcript of the test material. Because the applicant no longer must type a transcript of the test material, this bill strikes the reference to a manual or an electric typewriter. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 52.023(b), Government Code, to set forth that an applicant seeking certification as a court reporter must now prepare, rather than type, a transcript of the test material taken down by the applicant. Deletes the reference to the authorized use by an applicant of either a manual or an electric typewriter to type the transcript. SECTION 2.Emergency clause. Effective date: upon passage
