BACKGROUND AND PURPOSE 

The Texas State Technical College (TSTC) extension center in Marshall,
Texas was established in 1991, by the 72nd Legislature.  The school teaches
technical and vocational classes that assist in the advancement of the
students in the professional arena.  Currently, the extension center
operates under the administration of a campus.  H.B. 1049 designates the
extension center in Marshall as a campus of the TSTC System which may grant
associate degrees and certificates. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 135.02(a), Education Code, as amended by Section
3, Chapter 359, Acts of the 73rd Legislature, Regular Session, 1993, to
provide that the education facility located in the city of Marshall in
Harrison County is a campus of the Texas State Technical College System,
rather than an extension center. 

SECTION  2.  Amends Section 62.021(a), Education Code, to add the Texas
State Technical College-Marshall under the budget appropriated for the
Texas State Technical College System Administration. 

SECTION 3.  Repealer: Sections 135.02(d) and (e), Education Code.  Section
135.02(d) authorizes the board of regents for the Texas State Technical
College System to establish an extension center in the city of Marshall and
accept and acquire land for that purpose if approved by the Texas Higher
Education Coordinating Board.  Section 135.02(e) sets forth the intent of
the legislature in allowing the establishment of an extension center in the
city of Marshall. 

SECTION 4.  Effective date: September 1, 1999.

SECTION 5.  Emergency clause.
