HBA-MPM, MPM H.B. 1034 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1034 By: Jones, Jesse Public Education 3/25/1999 Introduced BACKGROUND AND PURPOSE Current law requires the board of trustees of a school district to adopt a student code of conduct for the district. Students violating this code may be suspended or removed from a classroom, campus, or alternative education program if the action occurred on or off school property or while attending a school-sponsored or school-related activity. H.B. 1034 limits the applicability of a district's code to a student's behavior on school property or while attending a school-sponsored or school-related activity on or off school property. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 37.001, Education Code, by adding Subsection (d), as follows: (d) Makes this section (relating to a student code of conduct and certain disciplinary measures that an independent school district is required to adopt) applicable only to a student's behavior on school property or while attending a school-sponsored or schoolrelated activity on or off school property, except as otherwise provided by this chapter. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
