Amending the Business and Commerce Code relating to misuse of dairy containers bearing a proprietary mark by clarifying and modernizing the definition of "dairy container," requiring the Texas Department of Health Resources to adopt rules and regulations to prevent deceptive trade practices and unauthorized private use of dairy containers, including but not limited to procedures for registration of propriety marks, with appropriate fees and annual renewals; deposits; creating offenses, prescribing penalties, declaring certain uses of dairy containers to be unauthorized prive use, providing for severability and declaring an emergency.
